La FIE ed il gioco delle tre tavolette. “English Version follows Italian one”

Ho letto con molto interesse gli interventi dalla platea di Otto Drakenberg, Presidente della Federazione Svedese di Scherma, delegato ufficiale al Congresso FIE di Losanna del 26 Novembre u.s., riportati su Twitter da Joonas Lyytinen, Presidente della Federazione Finlandese: https://twitter.com/joonasl/status/1596520283598454788.

Questo perchè, dai suoi commenti, sembrerebbe che  il Sig.Drakenberg fosse uno dei pochi che avesse capito il gioco delle tre tavolette (in Italia: delle tre carte, ovvero “la carta vince, la carta perde, dove è la carta?), che il ComEx stava propinando ai membri del Congresso, sulla ratifica dello status di Presidente ad interim del Signor Katsiadakis. Bisogna precisare però che, nel gioco delle tre tavolette, chi accetta di giocare è consapevole della abilità e della destrezza di chi dirige il gioco ed è per questo motivo che la la Corte di Cassazione Italiana, nel 2019 (sentenza n. 48159), ha stabilito il principio che il suddetto gioco non costituisce reato: “La consapevolezza esclude la truffa ed il raggiro. Senza tale consapevolezza, però, il raggiro sussiste”.

E, allora, è da chiedersi: come è stato perpetrato quindi questo gioco di prestigio sui delegati?

Per poter rispondere in modo esaustivo a tale interrogativo, occorre ricondurci inizialmente al punto 4 dell’agenda del Congresso - che riporto  “verbatim” - così recitava: Ratification of the Executive Committee’s decision regarding the appointment of the interim President. (tradotto in Italiano significa: Ratifica della decisione del Comitato Esecutivo relativa alla nomina del Presidente ad interim); e, dopo di che, precisare che, il giorno del Congresso, tale argomento è stato presentato come una semplice mozione che è stata votata, sic et simpliciter (come direbbero i latini), immediatamente dopo il coraggioso intervento Svedese. In tal modo,  il Congresso, nella sua collegialità, stante la parvenza di “semplice mozione”, derivata dalla maniera in cui questa era stata presentata, ha ratificato, senza alcuna difficoltà (111 SI; 24 NO e 2 astenuti), la precedente delibera del ComEx, sulla cui legittimità molti dubbi si nutrono

E’, quindi, abbastanza spontaneo chiedersi se i soci del Congresso fossero in effetti pienamente consapevoli di ciò che stavano votando, in considerazione soprattutto della assoluta mancanza di trasparenza da parte di una maggioranza del Comex, circostanza questa che porterebbe ad ipotizzare la sussistenza della su cennata fattispecie del raggiro. Per comprendere come ciò sia avvenuto è necessario riassumere alcuni fatti chiave e le corrispondenti azioni intraprese dal ComEx della FIE.

Informazioni di base

Come è noto, il presidente della FIE Usmanov non si è dimesso, né è stato rimosso dall'incarico dal ComEx della FIE. Piuttosto, il Sig. Usmanov si è temporaneamente auto-sospeso dall’esercizio delle sue funzioni di Presidente FIE, rilasciando la seguente dichiarazione, l’ 1 marzo 2022, sul sito web della FIE, che da allora, stranamente, è stata rimossa dal sito web.

Il 28 febbraio 2022 sono diventato il bersaglio di misure restrittive imposte dall'Unione Europea. Ritengo che tale decisione sia ingiusta e le ragioni addotte per giustificare le sanzioni sono un insieme di accuse false e diffamatorie che danneggiano il mio onore, la dignità e la reputazione aziendale. Userò tutti i mezzi legali per proteggere il mio onore e la mia reputazione.

Con la presente sospendo l'esercizio delle mie funzioni di Presidente della Federazione Internazionale di Scherma con effetto immediato fino al ripristino della giustizia.

Durante i due giorni successivi, rispettivamente il 2 e il 3 Marzo u.s., il ComEx ha intrapreso queste due importanti azioni esecutive, che, come i gemelli siamesi, fanno parte dello stesso ed identico modus agendi.

1. Il ComEx ha accettato e ratificato la decisione  del sig. Usmanov di "autosospendere temporaneamente" l'esercizio delle sue funzioni di Presidente della FIE.

2. Il ComEx ha nominato il Sig. Katsiadakis Presidente ad interim. Nomina che Sig. Katsiadakis ha accettato. Cfr. Lettera urgente FIE n. 1-22.. (https://static.fie.org/uploads/27/136005-lettre%20urgente%201-22%203%20L.pdf)

Quindi, la nomina del Sig. Katsiadakis a presidente ad interim a suo tempo fu basata sull'autosospensione del presidente Usmanov. Ciò nonostante, il suddetto punto 4 dell'ordine del giorno sottopose al Congresso solo la ratifica della nomina del signor Katsiadakis a presidente ad interim. Mentre l’auto sospensione del Presidente Usmanov, che è la genesi inseparabile della nomina di Katsiadakis a presidente ad interim, è stata intenzionalmente omessa da quello stesso punto 4 dell’agenda: ciò, evidentemente,  al solo fine di non attirare l’attenzione sullo status del Sig. Umanov all’interno della FIE, dal momento che non si è dimesso nè fatto decadere dalla sua posizione.

Quindi, il solo voto positivo e/o favorevole, con un semplice “SI”, sulla ratifica del Presidente Interim, conta, e soprattutto vale, anche come un implicito “SI” per il suo gemello siamese, cioè la ratifica dell’auto sospensione del Presidente Usmanov.

Tutto ciò non è certamente sfuggito all'attenzione del Sig. Drakenberg. che ha sollevato alcune questioni molto critiche dall'aula del Congresso sulla legittimità della procedura utilizzata dal ComEx della FIE, riguardante: (a) lo status del Segretario Generale della FIE; (b) l’autosospensione temporanea del sig. Usmanov; (c) ed alcune lacune negli statuti FIE, la cui interpretazione rimane tutt’ora poco chiara, durante un vivace dibattito con Nathalie Rodriguez, CEO della FIE.

Secondo il feed Twitter, gentilmente fornito personalmente e direttamente dal Sig. Joonas Lyytinen, alla platea del Congresso, c'era una situazione di "confusione e caos.” Ciò nonostante, le mozioni d'ordine, opportunamente sollevate dal Sig. Drakenberg, sono state sommariamente trattate e liquidate e non è mai seguita una discussione sulla legittimità delle azioni intraprese dal Sig. Usmanov e dal ComEx. Si è invece votato per la ratifica delle decisioni del ComEx, in merito al Presidente ad interim con il seguente esito 111 SI, 24 NO e 2 astenuti.

Resta inteso che se ci fosse un premio per la persona piu creativa dell’anno, tale premio dovrebbe senz’altro andare a chi ha pianificato il voto sul punto 4 dell’agenda.

Rimane un post scriptum importante: Se qualcuno crede che l'atto di "auto-sospensione temporanea" sia una questione minore, si sbaglia. THE FIE’s Three-Card Trick

I read with great interest the remarks made by Otto Drakenberg, President of the Swedish Fencing Federation, official delegate at the FIE Congress in Lausanne on November 26, 2022, as reported on Twitter by Joonas Lyytinen, President of the Finnish Federation. https://twitter.com/joonasl/status/1596520283598454788.
Mr. Drakensberg is one of the few delegates who understood the Three-card Trick, a confidence game in which the victims, or "marks,” are tricked into betting a sum of money, on the assumption that they can find the "money card" (typically the Queen) among three face-down playing cards.
Although in this case there was no betting involved, the FIE ComEx played a Three-Card Trick on the delegates when it asked them for the ratification of the status of Mr. Katsiadakis as FIE Interim President. To clarify, the difference between the well-known con game and that by ComEx is that in the con game the players are well-aware of the dealer’s ability and dexterity in hiding the Queen card and, therefore, they play the game at their own peril. At the FIE Congress instead, the game was played deceptively, unbeknownst to the delegates. In addition, the hidden card was not the Queen but the real status of Mr. Usmanov, the ‘temporarily self-suspended’ President of the FIE.
How was this sleight of hand perpetrated on the delegates?

4.  Ratification of the Executive Committee's decisions regarding the appointment of the Interim President.
On the day of the Congress this item was presented as a motion to ratify the ComEx decision to accept Mr. Usmanov ‘temporary self-suspension from the functions of President’ and put out to a vote immediately after the vigorous remarks of Mr. Drakenberg, Swedish Federation President, and delegate at the Congress, with a result of 111 YES, 24 NO and 2 abstentions.
One must wonder, however, whether members of Congress were aware of what they were voting for.
The deception, i.e., Three-card Trick in this case is the total lack of transparency on the part of a majority of ComEx. To fully understand how this could happen, it is necessary to review some of the relevant facts that occurred in the FIE in March of 2022.

• FIE President Usmanov did NOT submit a letter of resignation, and FIE ComEx did not remove him from his position as President.

• Mr. Usmanov personally decided the ‘suspend the exercise of his duties as the President of the FIE,’ by issuing the following statement on March 1, 2022, on the FIE website, which has since been removed from the website.

On 28 February 2022 I became the target of restrictive measures imposed by the European Union. I believe that such decision is unfair, and the reasons employed to justify the sanctions are a set of false and defamatory allegations damaging my honor, dignity, and business reputation. I will use all legal means to protect my honor and reputation.
I hereby suspend the exercise of my duties as the President of the International Fencing Federation effective immediately until justice is restored.
During the following two days, March 2^nd, and 3^rd, respectively, the FIE ComEx took these two important executive actions, which, like conjoined twins, are part of the same res gestae:
1.    FIE ComEX accepted and ratified Mr. Usmanov’s personal decision to ‘temporarily self-suspend’ the exercise of his duties as FIE President.
2.    FIE ComEx appointed, Mr. Katsiadakis, Interim President, which Mr. Katsiadakis accepted. See, FIE Urgent Letter N°1-22  (https://static.fie.org/uploads/27/136005-lettre%20urgente%201-22%203%20L.pdf).
Even though President Usmanov’s ‘temporary self-suspension’ was the genesis of Mr. Katsiadakis’ appointment as Interim President, item 4. of the agenda produced by FIE ComEx, submitted ONLY the Ratification of the Executive Committee's decisions regarding the appointment of the Interim President, not the ratification of the personal act of Mr. Usmanov to ‘temporarily self-suspend’ from the functions of FIE President.
 
Presumably, this was done not to draw attention to Mr. Usmanov's temporary suspended status in the FIE, since he did not resign and ComEx did not dismiss him. Therefore, a “YES” vote on the Interim President’s ratification also counted as an implied “YES” for its conjoined twin, i.e., the ratification of President Usmanov’s ‘temporary self-suspension from his functions of FIE President.’
All this did not escape the attention of Mr. Drakenberg who raised some very critical questions from the Congress’ floor on the legitimacy of the procedure used by FIE ComEx concerning (a) the status of the FIE General Secretary, (b) Mr. Usmanov's temporary self-suspension, (c) gaps in the current statutes, and their unclear interpretation, during a lively debate with Nathalie Rodriguez, FIE CEO.
According to the contemporary Twitter feed kindly provided by Mr. Joonas Lyytinen, there was a situation of “confusion and chaos” on the floor. Nevertheless, the point of order Mr. Drakensberg properly raised was summarily dismissed and a discussion on the legitimacy of the actions taken by Mr. Usmanov and ComEx never ensued. Instead, a vote was taken for ratification of ComEx’ decisions regarding Interim President with the following result 111 YES, 24 NO and 2 abstentions.
If there were an award for the most creative person of the year, it should certainly go to whoever planned the vote on point 4. of the agenda, as drafted.
An important post scriptum, If anyone believes that the act of ‘temporary self-suspension’ is a minor issue, they are wrong. In fact, “temporary suspension’ by sport leaders may last and be fought on for many years.
