AUTOSOSPENSIONE USMANOV: Chi è ora il Presidente della FIE?

La recente autosospensione del Presidente Usmanov e le relative misure adottate dall’esecutivo FIE, necessitano, a mio avviso, di chiarimenti da parte del Comitato Esecutivo e ciò al fine di evitare confusione e possibili malintesi nel mondo della scherma internazionale. Resta inteso che mi limito semplicemente ad una constatazione di fatti ed alla formulazione di alcune domande: senza alcun preconcetto o giudizio negativo verso il presidente della FIE ed i membri dell’esecutivo. Per i non addetti, è forse bene ricapitolare gli eventi più importanti.

• Il 1 Marzo c.m., il signor Usmanov si è autosospeso a tempo indeterminato dalle sue funzioni di Presidente: non avendo rassegnato le dimissioni è lecito supporre che sia ancora in carica;
• Il 2 Marzo c.m. , ai sensi dello Statuto FIE, l’esecutivo FIE ha accettato e ratificato l’autosospensione del Presidente ed ha nominato il Segretario Generale FIE, Emmanuel Katsiadakis, quale Presidente ad interim, che ha accettato la nomina;

• A seguito degli eventi bellici in Ukraina, il Presidente Usmanov è stato sanzionato dalla Unione Europea, dagli Stati Uniti d’America e dalla Confederazione Elvetica;
• È da rilevare che l’intersezione di una organizzazione con un individuo sanzionato presenta delle problematiche nuove che se non affrontate sistematicamente possono avere conseguenze drammatiche e ciò vale anche per la FIE ed il suo Comitato Esecutivo. Infatti, Individui ed entità che violano le sanzioni (direttamente o indirettamente) collaborando con un sanzionato possono essere arrestati e perseguiti ed avere i loro beni sequestrati. Sembra inoltre che nei rapporti commerciali la sospensione dei contratti non sia sufficiente. Per esempio, una maggioranza degli aeromobili commerciali in Russia sono utilizzati tramite dei contratti leasing con compagnie estere che ora sono costrette a cancellarli del tutto; stessa fine hanno i contratti del personale di bordo e di fornitura degli yacht sequestrati.

Pur tenendo in considerazione che lo Statuto FIE non contempli la sospensione (volontaria o involontaria che sia) del Presidente, la nomina del signor Katsiadakis è stata presumibilmente fatta ai sensi dell’Art. 5.3.3 dello statuto FIE il quale prevede che in caso di morte o dimissioni del Presidente, il Segretario Generale svolga le funzioni del Presidente in via provvisoria, fino al prossimo Congresso, durante il quale saranno organizzate le elezioni del nuovo Presidente. Inoltre l’Art. 5.6.1 dello Statuto, permette al Segretario Generale di sostituire il Presidente a riunioni o eventi in caso di impedimento.

Senza entrare in una disamina della nomina del signor Katsiadakis a Presidente ad Interim, poiché a mio avviso, secondo una interpretazione testuale dello Statuto, egli sarebbe dovuto restare nella sua posizione di Segretario Generale (pur facendo le veci del Presidente), capisco che una interpretazione pragmatica dello Statuto FIE - come probabilmente adottata dal Comitato Esecutivo, sia stata dettata dalla necessità di far vedere al mondo che la FIE ha un Presidente, effettivo, in carica. Il mio timore però é che una Procura che indagasse sull’ osservanza delle sanzioni potrebbe erroneamente interpretarlo invece come un gioco di specchi. Ad ogni modo, l’Art. 5.5.5 dello statuto dà al Comitato Esecutivo il potere esclusivo di interpretare gli articoli dello Statuto e del Regolamento FIE. Quindi per evitare malintesi di qualsiasi genere e data l’unicità della situazione in cui si trova la FIE, credo, e lo dico rispettosamente, che il Comitato Esecutivo debba porsi delle domande in relazione alla gestione dell’Organismo che, secondo lo statuto, ricade tra le responsabilità del Comitato Esecutivo. Con l’atto dell’autosospensione, il presidente Usmanov ha dimostrato di essere persona corretta. Ora tocca al Comitato Esecutivo assumere la gestione e fare il punto su una situazione veramente difficile al quale, comunque ricordo che l’autosospensione è una decisione autonoma di esentarsi da una funzione o da un incarico per un periodo limitato di tempo, che non può durare indefinitivamente.

Queste le domande che vorrei porre all’attenzione del Comitato Esecutivo FIE:

1. Dato che le dimissioni non sono state formalizzate ma si è in presenza solo di autosospensione dall’esercizio delle funzioni di Presidente (caso, peraltro, non previsto dalla Statuto), il Signor Usmanov è tuttora Presidente Titolare della FIE? ;
2. Se invece il Comitato Esecutivo ritiene che il Signor Usmanov non sia più il Presidente Titolare della FIE, potrebbe chiarire quale è allora la sua posizione nell’organico della FIE? ;
3. Se invece il Comitato Esecutivo concorda che il Signor Usmanov rimane Presidente Titolare delle FIE, potrebbe chiarire il perché della nomina del Signor Katsiadakis a President ad Interim, dato che la FIE ha tuttora un Presidente titolare? ;
4. Quando scade il mandato “ad Interim” del Signor Katsiadakis? Fino al prossimo Congresso? Oppure solo fino al momento in cui il Signor Usmanov decide lui stesso di terminare la propria sospensione dall’esercizio delle sue funzioni di Presidente? ;
5. Chi copre ora la carica di Segretario Generale della FIE? ;
6. Per quale motivo il Signor Katsiadakis, non ha mantenuto la sua posizione di Segretario Generale, facendo le veci del Presidente, come indicato dall’Art. 5.3.3 dello Statuto? ;
7. Che misure e protocolli ha adottato il Comitato Esecutivo per proteggere se stesso e la FIE da eventuali violazioni -dirette ed indirette- delle sanzioni imposte dall’ Unione Europea, dagli Stati Uniti d’America e dalla Confederazione Elvetica?;
8. Avere un Presidente sanzionato “in sospeso” (titolare o meno) è sufficiente per essere conformi o, meglio, per essere considerati al riparo dalle esigenze imposte dalle sanzioni? ;
9. In finis, la domanda più importante: Chi è ora il Presidente della FIE?

USMANOV’ S SELF-SUSPENSION: Who is the President of the FIE now?
The self-imposed suspension  from his duties of President of the FIE recently undertaken by Mr. Usmanov -as well as its subsequent ratification by Executive Committee,  raises certain issues, which  in my opinion, require clarification by the Executive Committee; this, to avoid confusion and possible misunderstandings in the world of international fencing. To that end, my comments are limited to the framing of  certain questions arising out of the actions taken by the Executive Committee, without any preconception or negative judgment in regards to the President of the FIE and/or  the members of the FIE Executive Committee.
It is perhaps best  to recap the most important events.

• On March 1st, Mr. Usmanov suspended himself indefinitely from his functions as President: having not resigned, it is reasonable to assume that he is still in office;
• On March 2nd, pursuant to the FIE Statute, the FIE executive committee accepted and ratified the self-suspension of the President and appointed the FIE Secretary General, Emmanuel Katsiadakis, as interim President, who, in turn, accepted the appointment;
• Following the tragic  events in Ukraine, President Usmanov was sanctioned by the European Union, the United States of America and the Swiss Confederation;
• It should be noted that the intersection of an organization with a sanctioned individual presents new problems which, if not addressed systematically, can have dramatic consequences; and this also applies to the FIE and its Executive Committee. In fact, Individuals and/or entities who violate sanctions (whether directly or indirectly) by collaborating with a sanctioned person can be arrested and prosecuted and have their assets seized. By way of analogy, it seems  that in commercial relations the suspension of contracts is not sufficient to comply with sanctions. For example, a majority of commercial aircraft in Russia are operated through leasing contracts with foreign companies, which are now forced to cancel them altogether; the same happened to the contracts for on-board personnel and for the supplier contracts  of the seized yachts. 

While taking into consideration that the FIE Statute does not provide for the suspension (whether voluntary or involuntary) of the President, the appointment of Mr. Katsiadakis was presumably made pursuant to Article 5.3.3 of the FIE statute, which  provides that in the event of the death or resignation of the President, the Secretary General performs the functions of the President on a provisional basis, until the next Congress, during which elections for the new President will be organized. Furthermore, Article 5.6.1 of the Statute, allows the Secretary General to replace the President at meetings or events in case the President is unable to attend.
Without dwelling too much on the appointment of Mr. Katsiadakis as Interim President, since in my opinion (according to a textual interpretation of the Statute), he should have remained in his position as Secretary General (while acting in the place of the President), I understand that a more pragmatic approach may have been  dictated by the need to show the world that the FIE has an effective President in office. My fear, however, is that a prosecutor investigating compliance with the sanctions could erroneously interpret it, instead,  as a game of mirrors. In any case, Art. 5.5.5 of the Statute gives the Executive Committee the exclusive power to interpret the the Statute and the the Administrative  Regulations of the FIE.
To avoid misunderstandings of any kind and given the uniqueness of the situation in which the FIE finds itself, I respectfully, pose some questions to the Executive Committee because the Executive Committee   Is charged with the management of the FIE and because President Usmanov acted correctly in suspending himself.  Now it is up to the Executive Committee to take over the management of the FiE and take stock of a really difficult situation.  Furthermore, it is important to note that a suspension (whether voluntary or involuntary) cannot last indefinitely.
These are the questions I would like to put to the attention of the FIE Executive Committee:

1. Given that he did not resign but only suspended himself from exercising his duties as President, is Mr. Usmanov still the Titular President of the FIE? ;
2. If, on the other hand, the Executive Committee believes that Mr. Usmanov is no longer the Titular President of the FIE, could it clarify what is his position within the FIE? ;
3. If, on the other hand, the Executive Committee agrees that Mr. Usmanov remains the Titular President of the FIE, could it clarify the reason for the appointment of Mr. Katsiadakis as President ad Interim, given that the FIE still has a Titular President? ;
4. When does Mr. Katsiadakis' "ad Interim" mandate expire? Until the next Congress? Or only until the moment in which Mr. Usmanov himself decides to end his suspension from the exercise of his functions as President? ;
5. Who now holds the position of Secretary General of the FIE? ;
6. Why did Mr. Katsiadakis not maintain his position as Secretary General, taking the place of the President, as indicated by Art. 5.3.3 of the Statute? ;

7. What measures and protocols has the Executive Committee adopted to protect itself and the FIE from any violations - direct and indirect - of the sanctions imposed by the European Union, the United States of America and the Swiss Confederation ?;
8. Is having a sanctioned President in a “suspended” status (whether voluntary or involuntary) sufficient to comply with the requirements imposed by the sanctions? ;
9. Finally, the most important question: Who is now the President of the FIE?
